So this happened in Washington state when I was in college some years ago, before marijuana was legalized, but I'm just curious if mine or my friend's 4th amendment rights were violated.
One night I picked up a friend from a party to drive her home, and I got pulled over for a minor traffic violation (which I'll admit I was guilty of). When the officer came up to my window, he said he smelled alcohol and marijuana, and asked if I had consumed either or if I was in possession of marijuana. I told him i had done neither (the truth). He then asked me to step out of the car, said I was under arrest for marijuana possession, and read me my rights.
He asked if I would consent to a search of my car, and I did, because I didn't want to have to call my parents from jail (they were in town for Dad's weekend), and I knew I didn't have anything in my car. Stupid, I know, but I was a nervous kid. He searched my car while I sat in his cruiser, and of course he found nothing. He then asked my friend if he could search her purse, she said no, and then he arrested her and searched her purse anyway.
Were either of those arrests legal?
