My apartment made a mistake, but is trying to say they don't have to do anything about it.

A few weeks ago, letters were hand delivered to the apartments in my building. The letters were explaining upcoming renovations to the property, and encouraging people to select a transfer date to move into a renovated unit. It also noted that they were allowing people to select their move out date if they didn't want to transfer, and gave a list of about 5 dates, and they asked for 60 day notice. My wife and I aren't super happy with the apartment, so we decided to elect to move out may 31st, and gave them 61 days notice. We handed written notice to the administrator onsite, and went to an apartment showing. We loved the place and applied and signed that day.

The next day, the property management said they didn't mean to give us the notice, as it was intended only for residents in un-remodeled units, and thusly we can't end our lease early. We are in a remodeled unit, and what he said makes sense, but it also didn't say that on the letter.

In an email to his team, which he CC'd us on, he admits that there was a mistake, but said he is unwilling to make an exception unless they can rent the unit to someone else early.

Their mistake could cost us 2 extra months of double rent, which we don't really have the money for right now. What are my options? I'm willing to go to small claims court if necessary, but I don't even know if I have a case.
