My parents bought a home two years ago in North Carolina. They had a falling out with their neighbors who found that they own a portion of my parents driveway. The driveway is in the shape of the letter “U” which connects to the main road. The neighbors found that they own about a foot onto the one side of their driveway and want to shut down that part of the driveway to plant trees.
We’ve talked to various people but no one can really help us. One possible defense that we’ve found is that the driveway has been there for 20 years, which may be protectable under North Carolina law. Another possible defense may be that emergency vehicles cannot get down the other half of the driveway due to trees and because it’s a narrow path.
Would greatly appreciate any advise or possible defenses. It’s been terrible trying to find a lawyer because they live in a small area. Thanks!
Edit: My parents have not had their own survey performed. The neighbors have already planted trees and stuck a no trespassing sign in the middle of their driveway.
