The background: When I was 20(F), I fell into a severe depression. After months of trying to manage it, I admitted myself into an inpatient psychiatric hospital because I was becoming severely suicidal. For 2 weeks I lived in an inpatient rehab facility and I improved a lot, but I still needed help with depression symptoms. The hospital placed me into their partial hospitalization program so I could transition back to “normal” life but still receive treatment 5 days a week.
The therapist (40s, M) who ran the partial hospitalization program started telling me that “you need to be shown that you have value” and that my depression could be reversed with exposure to such affirmations. Hindsight is 20/20 but because I trusted the hospital that had already helped me a lot, I listened to this therapist and figured he was telling the other patients the same thing.
Eventually I ran out of money and had to quit the hospitalization program because I had no insurance. About 2 weeks after discharge, I started feeling very suicidal again and also started receiving emails from the therapist. I ignored him at first. He offered me therapy at his private office, and I caved. I was raped under the guise of “you need this to get better”.
Obviously I didn’t get better, I got PTSD instead, and I sued the hospital. My lawyer found out the therapist had a felony conviction for voyeurism and his LMFT license was on probation, and the hospital didn’t even run a background check on him. The therapist admitted he “had sex with” me in his deposition. After 2 years of litigation, I won my case against the hospital. I also sued the therapist in the same lawsuit but he claimed to have no money.
This all happened in Indiana. At the start of the lawsuit, I immediately reported the therapist to the Indiana licensing board. But it turned out that he gave up his license and fled the state, so he could apply for a LMFT or LCSW license in another state without any red flags. He moved to Alabama where he is now. My lawyer filed a complaint with the Alabama licensing board during the lawsuit and his therapy license was revoked.
However, it didn’t stop him. He created a private practice with a website and has a physical office. The lawsuit was over when I found this out, and my lawyer was a disbelieving asshole the entire time, so I immediately filed a complaint myself with the Alabama licensing board, explaining that he assaulted me and should not be giving therapy to anyone.
Alabama must have taken action because his website was taken down. I thought it was finally over. Now his website is back up, and he’s calling himself a “pastoral counselor”.
Do I have any legal options to stop this? I’d ask my lawyer but he’s an asshole who is no longer interested in returning calls since the lawsuit settled.
