Our landlord (West Virginia) claims we broke our microwave but the latch is worn out because it’s an older microwave. And our oven’s control panel stopped working and needed replaced. We were told that we broke it but if you look up the oven model it is a VERY common problem. It’s not like I punched the oven or took a hammer to the microwave latch. Both my roommate and I have talked to him on multiple occasions and he still thinks we have to pay. We both paid $850 so it’s not like a small amount I can easily dismiss.
The lease says “reasonable wear and tear is expected...and agrees to pay for damages due to willful negligence.” Am I wrong to assume that this is normal wear and tear? We had no control over these damages and they are very common issues. They are trying to sell the building so it seems like they don’t want to put in any more money into the building. I have had personal property get water damaged due to their “negligence” including; rented text books that I have to buy since they were damaged, my mattress, sheets, pillows, a comforter, and a night stand. So I think we are even. But anyway, do I have fight here? Should I waste my time fighting this? Am I wrong and we should have to pay?
