So long story, around like 2 years ago my mom sold a dog to this lady under a non breeding agreement. This lady bred the dog a little while ago around Christmas and tried to hide it from my mom and of course she found out.
The contract says that she owes us $1500 per puppy born. It also says that breaking the contract costs 5x the original puppy price (the price we sold the dog for two years ago). And that she covers legal fees and whatever else. It also says that if any part of the contract is broken, that my mom or an agent my mom sends can come and take the dog back.
So two days ago, my mom sent this guy over to get the dog. (Another break in the contract because the dog was supposed to stay with the lady unless she had written consent from my mother). From my knowledge, everything went smoothly and the guy who had the dog gave the dog and the two puppies that he still had. He had been the one taking care of the dog and had been the one raising the puppy. There were also pictures of the dog on the guys Facebook of the dog looking very under weight and skinny (another break in the contract). He had been selling the puppies on Kijiji for around $200-500 and was selling them as young as around 2 weeks old.
The lady we sold the dog to called the police and said we had broken into her house and stolen her dog. The police found out that she was lying and that the dog is legally ours. She also said that she never signed a contract but we have the contract signed and she was given her own contract.
My mom doesn’t want to go to court because the lady is on permanent leave from work so she only gets $1000 per month. I told her that she should try and take her to court but my mom thinks that the judge won’t make the lady pay anything and my mom will have to pay court fees.
Should my mom take the lady to court? Or should she just let it go?
