Original post: [USA-CA] Downstairs neighbor has served me Temporary Restraining Order for "Walking too loudly"
TL;DR: Downstairs neighbor filed a TRO against me for 'Banging on my apartment floor' with the intent to harass them and disturbed their sleep. It was 'Denied until hearing' at time of filing. Hearing was yesterday.
First off, thank you all the Redditors who responded on the original post! It helped a lot.
- The judge dismissed the case.
- In giving his decision, he made the comment (verbatim) "The decision was on the cards... I mean come on guys. You saw it was denied even in the original request until hearing."
- He also made a comment that even if he were to grant a restraining order, it would be impossible to enforce if they were to call the cops on me, because the cops would want to hear the 'noise' before they arrest me.
- He read my neighbor from the statute 527.6 and told them that based on evidence, there was (a) no threat of violence or (b) intent of harassment from my side.
This has been a great learning experience. I wish I could've shown my neighbors the finger after the decision was given. Fucking assholes...
