[update] HVAC Company suing me under the wrong entity.

The HVAC Company owner showed up and kept playing with his cell phone 5 feet from the bailiff after she asked him to stop multiple times and got kicked out of the courtroom.

After 2 hours of waiting they let him back in and heard our case. Within 30 seconds I handed the judge the contract between myself and his company and she dismissed the whole thing. He said he anticipated this to the judge, which to me means this was a frivolous lawsuit since he named me and my wife, who had to miss work that day. He said he didn’t do it under the business entity so he could not have to use a lawyer. Then he asked if I would be liable for any lawyers fees if he did use one. She said no.

Small victory, but only for a day. I got served papers for the same thing under the correct entity the next day.

Time to file a counterclaim. I’ll keep you updated if anyone cares.
